Terms of Service

These terms govern your use of Whispervoice (the desktop app, the website, and the underlying API). By creating an account or using the service you agree to these terms.
1. The service
Whispervoice is a dictation tool. You hold a hotkey, speak, and the app inserts cleaned-up text at your cursor. The service is operated by Tumpak & Welge Media; see the imprint for contact details.
2. Account
You need an account to use Whispervoice. You are responsible for keeping your sign-in credentials safe. Tell us at business@whispervoice.ai if you suspect someone else is using your account.
Accounts are personal. Sharing an account with other people is not permitted; running automated or bulk-dictation workloads outside normal human use is not permitted either.
3. Plans and billing
- Free. Limited monthly word allowance. No credit card required.
- Pro. Unlimited dictation, billed monthly via Stripe. You can cancel at any time; access continues until the end of the billing period you have already paid for.
Prices are shown in EUR and include any applicable VAT. We may change prices for future billing periods with 30 days notice via email.
4. Right of withdrawal (EU consumers)
If you are a consumer in the EU, you have the right to withdraw from the contract within 14 days without giving a reason. To exercise it, email business@whispervoice.ai with a clear statement of withdrawal. We will refund payments made during that period within 14 days.
Note: by starting to use the Pro features during the withdrawal period you expressly consent to immediate performance of the service and acknowledge that you lose the right of withdrawal for the portion of the service already used (§ 356 (4) BGB).
5. Refunds outside the withdrawal period
We offer refunds at our discretion outside the legal withdrawal period — typically for technical issues that prevent normal use. Email business@whispervoice.ai. If a charge is fully refunded, the Pro entitlement is revoked immediately. Partial refunds (e.g. goodwill credit) do not affect your subscription.
6. Acceptable use
You agree not to use Whispervoice to:
- Generate or distribute illegal content.
- Impersonate another person or organisation.
- Circumvent quotas, reverse-engineer the API, or scrape the service.
- Process content for which you do not have the necessary rights or consent of the speaker.
We may suspend or terminate accounts that violate these rules. For severe violations (fraud, abuse, chargebacks) we may do so without prior notice.
7. Your content
You retain all rights to the audio you submit and the text you receive. You grant us only the rights necessary to deliver the service: sending your audio to our speech-to-text provider for transcription and the resulting text to the cleanup provider for processing. 8. Service availability
We aim for high availability but the service is provided on a best-effort basis. We may perform maintenance, update components, or change the underlying AI providers with reasonable notice for major changes.
9. Disclaimer of warranties
AI transcription and cleanup are probabilistic. The output may contain errors. Always review transcripts before relying on them for important decisions or communications. Whispervoice is provided "as is" to the extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law our liability for indirect or consequential damages is excluded. For other damages our liability is limited to the amount you paid us in the twelve months before the event giving rise to the claim. This does not limit liability for intent, gross negligence, personal injury, or any liability that cannot be excluded under German law.
11. Termination
You can close your account at any time from the dashboard. We can terminate your account for breach of these terms with reasonable notice, or immediately for severe violations.
12. Changes
We may update these terms. If we make material changes we will notify you by email before they take effect. Continued use after the effective date counts as acceptance of the new terms.
13. Governing law and venue
These terms are governed by the law of the Federal Republic of Germany. If you are a consumer this does not affect mandatory consumer protections of the country in which you reside. Place of jurisdiction for merchants is Hamburg.
14. Online dispute resolution
The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
